『国境なき記者団(Reporters sans frontières / Reporters Without Borders / RSF)』は、日本の衆院で昨日26日、情報の自由に対する未曾有の脅威となり得る「特定秘密保護法案」が可決されたことに対する遺憾の意を表明し、安倍晋三首相の政府に対し、当該法案の撤回を求める。
「あらゆる都合の悪い情報を“国家秘密”に指定することのできる法を制定するようでは、どのようにして、福島原発事故の影響から怒り心頭する国民の間で高まる、更なる透明性を求める声に応えられるというのか」、RSFはこう述べた。
「秘密指定された情報を、“極めて不当な手段”で入手及びこれを掲載したとして対象者に重い刑罰を課すことで、日本の国会は調査報道を非合法化し、情報源の秘匿と公益の実現という報道の根本原則を踏みにじっている。」
当該法案では、「秘密」と判断される情報はその後5年間「国家秘密」扱いとなり、この期間は無期限で延長できる。秘密扱いの情報を漏洩した政府職員や報道記者を含む内部告発者(公益通報者)は、公表の根拠として「公益に資する」ことを証明することもなく、最長で懲役10年に処せられる。
当該法案は、報道記者を明示的に対象としており、当局により、入手した秘密情報の入手手段の適正さが判断されることになる。
安倍首相は、中国との海上国境線の問題や、北朝鮮の核開発への野心等の「アジアの変化する安全保障環境」を当該法案正当化の理由として挙げている。
外国特派員協会(FCCJ)は11月始めに声明を発表し、当該法案の廃案化か、少なくとも報道の自由を守れるだけの大幅な修正を国会に求めた。
当該法案の衆院での可決は、国境なき記者団が記録する報道の自由に対する侵害行為が相次ぐ中、とりわけ2011年の東日本大震災に伴い発生した福島原子力発電所事故後に、フリーランスのジャーナリスト等に対するそれらの行為の影響が高まる中で行われた。 
福島原発事故後、その影響を報道する試みに対しては、政府に透明性の欠如を訴えようとしたジャーナリストが告訴されるなど、多くの妨害行為が行われてきた。
日本は、『2013年度国境なき記者団報道の自由度指標』(原典:2013 Reporters Without Borders press freedom index)において、179か国中53位という記録的な転落を喫した。これは、2012年度指標から実に31ポイントの降格である。

あなたが日本に住んでいるのならば、「知る権利」が「黙る権利」へと置き換わっていることに驚くかもしれない。
シッ、静かに。抗議してはいけない。
最早、既成事実も同然なのだから。
問題の秘密保護法案の1つ目の原則は、「秘密は秘密である」ということだ。

2つ目の原則は、秘密を漏洩する者または記事の掲載や放送を通じてこれを公表する記者は、懲役10年以下に処せられるということ。

3つ目の原則は、どの国家機関が国家秘密を秘密とするかを定める規則はなく、これら国家機関が特権を濫用しないことを監視・監督する仕組みがないということ。すなわち、職務を満足に遂行しない機関ですら、その情報を秘密指定できるわけだ。

4つ目の原則は、原子力に関するあらゆる事項が国家秘密に指定されることだ。つまり、この国において原子力の問題は、その問題を知る術がなくなるのだから、存在しなくなるという寸法だ。そして何も知らなければ、何も被害を被ることもないと。
国民の「知る権利」は、これを以て正式に「政府が国民に知り得て欲しくない情報を政府が国民に知らせない権利」に取って代わられた、ということである。
日本国民の皆さん、ようこそ!

安倍晋三首相率いる自民党、公明党、そしてみんなの党によりもたらされる、日本の暗黒時代の到来だ!
これまでの経済の動向や、政府の決定、政治家の行動などが「不透明」と思えたならば、支配層はこれらを「漆黒の闇」に塗りつぶそうとしていると考えた方がいい。

あらゆる大手報道機関が法案に反対している。先週は、数千にも及ぶ一般市民が路上に繰り出し、同法案に対する抗議デモを行った。
民意にひじょうに敏感になっている自民党は26日、決定的な行動に打って出た。午前中に審議を行い、これを国営放送のNHKに報じさせた。だがNHKの中継が途中で中止された途端、自民党は審議を終了し衆院での強行採決に訴えたのである。まさに民主国家ならではの行動であるといえよう。[※訳注:全体を通じ本文での表現は筆者の皮肉だと思われます]
これで、残るは参議院のみとなった。
問題の法案は、政府与党勢力に反抗するあらゆる個人を逮捕収監した、戦前の治安維持法に準えられる。
「日本には既に極めて脆弱な情報公開法しかないというのに、この法案でそれが機能しなくなってしまう」
と語るのは、日弁連秘密保全法制対策本部のメンバー[訳注:事務局次長]である齋藤裕弁護士。
「この法案は米国の国家安全保障法の悪い所ばかりを採用して、その保護措置や監視・監督の仕組みに関する部分を全て取っ払っている」

一部の世論調査によると、政府がこの新しい法を、スキャンダルや汚職、そして都合の悪い情報の隠蔽に悪用するのではないかと感じる国民は八割以上に上るという。 


この政府不信には、60年代に起きた企業利益温存のための水俣病の隠蔽、90年代に起きたHIVエイズ血液製剤に関するスキャンダル、そして00年代に起きた福島第一・第二原発の安全性に関する暴露記事を封殺した経産省の動きなど、十分な根拠がある

安倍首相は、法案には附則で明確に、法制の監視/監督を行う「第三者機関を設置すべき」と謳っていると保証している。

国民は安倍首相を信じる「べき」なのだろうが、私は信じない。日本社会は、政府が何をしているかを「知る権利」と報道の自由が保障される社会である「べき」だと信じるからだ。
安倍首相の、「監督機関があるべき」という主張は、その実現には結びつかない。そしてごく最近の例を振り返れば、仮に申し訳程度の監督機関が作られたとしても、国民の「知る権利」を守るという意味では、福島第一原発での三重のメルトダウンを見事に阻止できなかった原子力保安院程度の有効性しか見出せないだろう。
国境なき記者団(RSF)は27日、法案を的確に批難した
あらゆる都合の悪い情報を“国家秘密”に指定することのできる法を制定するようでは、どのようにして、福島原発事故の影響から怒り心頭する国民の間で高まる、更なる透明性を求める声に応えられるというのか」(“How can the government respond to growing demands for transparency from a public outraged by the consequences of the Fukushima nuclear accident if it enacts a law that gives it a free hand to classify any information considered too sensitive as a ‘state secret’?”)

RSFはその声明の中で、報道の自由度ランキングにおける日本の地位は、2012年度のそれから記録的な31ポイントの急落をマークし、179か国中53位に転落したことに触れた。

小野副広報官(@HikarikoOno はCNNの取材に対し、このよう応え、強気の姿勢を見せた。

世界は常にあべこべ


まず私は、こう仮定することから始める。
この世界はすべてがあべこべだと。

すべてが間違っており、
間違った人びとが罪を問われ、

間違った人びとが権力を握り、
あるいは権力の座を追われ、
そしてこの国や世界の富が、
小手先の改革ではなく、
劇的な富の再分配を必要とするような
分配のされ方をしている、と。

「市民的不服従」という

「市民的不服従」を話題にした突端、

問題は、そこにあるのではない。
問題は、「市民的服従」にある。

問題は、世界中の多くの人びとが、
それぞれの政府の指導者の命じるがまま、
付き従ってきたことにある。

そして服従したがために、戦争が起こり、
数百万もの人びとが殺されたことにある。

ナチスドイツがまさに、そうだった。

問題が服従にあったことは、もう分かっている。
人びとは、ヒトラーに従った。

人びとは従った。それが間違いだった。

人びとは疑問を唱えるべきだった。
そして抵抗すべきだった。

我々がその場にいたら、きっと、
そうして見せただろう。

スターリンの時代のロシアでもそうだった。
人びとは従順だった。まるで家畜のように。

搾取されるのが当たり前の
封建時代のようではないか。
中世は、あまりにも悲惨な時代だったではないか。

だが現代においては、
西洋文明が栄え、「
法の支配」がある。

法の支配がもたらしたもの


「法の支配」は、それ以前に存在した
社会的不正を常態化し、かつ極大化した。

我々は気付かなければならない。

権力と戯れる者たち


ニクソン大統領は、我々よりも

ブレジネフ書記長に共鳴していた。

フーバー長官は、我々よりも
むしろ
ソ連秘密警察の長官に
はるかに共鳴していた。

法や秩序に対する国際奉仕の精神が、
世界中の指導者たちを、

矮小な、厳格な法解釈のみでしか成立しえない罪を問い、
大罪を犯した者の罪を問わないことを求める法に
従うことをやめなければならない。

私の願いは、こうした精神の発露が、この国だけでなく、
他の国々でも起きることだ。なぜなら、どの国にも
必要な精神だからだ。

世界のあらゆる国々の人びとに、
国家に対する不服従の精神が求められている。
それも、抽象的なものではなく、
力と豊かさに溢れるものが。

そして、同じものを希求する世界中の
すべての国々の人びとが、
『相互依存宣言』のようなものを
行うことが求められているのだと思う。

According to Kahoku Shimpo, as part of a cleanup process of the crippled Fukushima Daiichi Nuclear Power Plant, its operator Tokyo Electric Power Co. (TEPCO) has commenced its operation of removing the nuclear fuels from Reactor No. 4 this Monday. The removal of spent fuels from the crippled reactors "will mark the beginning of a new stage of the plant's decommissioning process that is estimated to take at least four decades," Miyagi Prefecture's local newspaper reported.

According to the report, the removal of the first fuel assembly started at 3:18 p.m. of the same day. The operators manipulated the "fuel handling machine" and lifted the 4.5-meter-long "fuel assembly", in a pace of one centimeter per second, and then transferred it onto a 5.5-meter cask--a steel-made transfer chamber that weighs 90 tons if willed to maximum capacity--in the the water. The operation was repeated for 40 minutes per unit, completing the loading of four units by 6:45 p.m. to end the operation for the day.




Kahoku reports that the task of loading the cask with 22 fuel assemblies is to be completed by Tuesday afternoon (November 19). The loaded cask itself will then be lifted by a large crane and transported to a common storage pool about 100 meters away.

The spent fuel pool or SPF still contains the remains of small debris from the blast that destroyed the main reactor building. The assemblies may contact these debris upon their removal. But according to Kahoku, TEPCO says, "We will put safety at the top while proceeding with our operations."

The SPF stores 1,533 units of fuel assemblies, of which 202 are new fuels that are relatively easy to remove. TEPCO plans to remove them first. The remaining 1,331 units that contain highly irradiated spent fuel will all be removed and transferred to the common storage pool by the end of 2014.

The SPF of Reactor 4 contains three units of damaged fuel assemblies that are deemed difficult to remove. TEPCO is considering to build a new transport chamber to address this problem.

At the time of the earthquake that crippled the plant two-and-a-half years ago, Reactor 4 was going through a regular inspection and all of its fuels within the reactor core were transferred to the neighboring spent fuel pool, thus managing to avoid core melt down. However, if the water in the SPF is depleted, a massive amount of highly irradiated substances could leak out. The international community has been imploring TEPCO to address the problem and secure a safe storage of the spent fuels.

The removal of the fuels from Reactors 1-3 is to commence after 2015, but the recent revelation of the fact that 70 out of 292 units of fuel assemblies stored in Reactor 1 are damaged is raising concerns of its impact to the entire removal schedule. (related story)

Kahoku's Editorial Comment: 

The excuse of "unexpected events" is no longer acceptable

As the operation of removing the spent fuel from Reactor 4 commences, TEPCO is seeing this as a rare opportunity to demonstrate that everything is proceeding as planned in the decommissioning process of the crippled Fukushima Daiichi Power Plant, as they have been under a strong criticism in the way it has dealt with problems like contaminated radioactive water leakage and 'unexpected' blackouts, having the tendency to "approach issues with an optimistic outlook." Hence, TEPCO has placed the removal operation as one of its chief goals for the time being.

One of the major concerns over the removal operation is the possibility that the fuel cask may fall. If it falls from five stories above the reactor building, it could damage the fuel assemblies. If the cast breaks, a highly irradiated substances may be dispersed into the air, causing a severe problem.

TEPCO claims that they have prepared for everything that they can expect. They say they have prepared not only for the falling of the cask but for each cases, for example on emergency cooling of the SPF, leakage of the water in the SPF, earthquakes, fires, and even accidents caused by the transport trailers. So they have prepared a case-by-base scenario, but what if they happen simultaneously all at once in multiple instances? TEPCO assumes, "Such a thing will never happen."

In normal operation, the cranes transferring the fuel assemblies operate automatically. However, in this operation, it is done manually by the operator. The operator will wear a full-sized mask that may narrow the field of vision. There is no guarantee that there will be no human error caused due to difference in the operational environment.

The disaster that crippled the site two years and eight months ago occurred in multitude of instances. TEPCO must be vigilant on their plans that extend to the end of next year to ensure that their plans are fool-proof. We can no longer afford to accept the excuses of "unexpected events" any more.

According to Kahoku Shimpo, 70 of the fuel assemblies in the spent fuel pool (SPF) of Reactor 1 of the Fukushima Daiichi Nuclear Power Plant, which accounts to a quarter of total of 292 of them stored within the SPF, was damaged before the Great East Japan Earthquake hit the area on 11 March 2011 crippling the facility, its operator Tokyo Electric Power Company (TEPCO) revealed on Friday. This has raised concerns of the planned removal of fuel and decommissioning operation of the same reactor scheduled to begin as early as 2017, as technologies to remove a damaged fuel assembly have yet to be established, reports the local newspaper.

Until Friday, TEPCO has never revealed the details on the matter. But as they explained they insisted that they have "always informed the government." According to them, the 70 fuel assemblies in question were removed from the reactor and stored in a different location within the SPF due to "leakage of radioactive substances out of small holes found in them," creating recurring problems. 

The fuel removal scheduled to begin on Monday for Reactor 4 has also suffered a setback, as there are at least three fuel assemblies that are also damaged and the company has determined that it would be too difficult to perform and has set them aside for future operations. (related story)

Aside from Reactors 1 and 4, Reactor 2 has three, and Reactor 3 has four assemblies that are also damaged, making the total number of damaged assemblies to 80. TEPCO is considering the option of building a new dedicated transport vessel to address the issue.

On the reason why so many of the damaged assemblies are concentrated in Reactor 1, TEPCO explained, 


"Reactor 1 is our oldest power station and we have heard reports that the quality control of the fuel rods during their production was poor and the product quality was also inferior. Rods for Reactor 2 and beyond have been refined and their quality have improved."
