【コメント】イラク戦争の総括が未だ行えない日本~ブレア英元首相の「謝罪」報道を受けて~ #安保法制



及び腰な国内報道


長年「対イラク武力行使」として議論されてきたイラク戦争の正当な総括が、遂に戦争の最大の当事国の一つである英国の当時の元首相からもたらされた。このこ と自体は感慨深い。しかしその報道のされ方が、戦争に賛同したこの国において、やや”及び腰”であることには不満をおぼえる。

今回ログルでまとめた英紙デイリーミラーのハイライトは、英紙が報じたそのままのものだ。つまり、米英が始めた戦争の最大の当事者の一翼を担った英国のメディアは、あくまでブレアが戦争の過ちを認め謝罪したことに焦点を置いた。戦争当事国としての一大ニュースはその一点にあるのだ。


ところが国内の報道では、ブレアが「サダム失脚については謝罪しない」としたことを、さも両論併記の原則を保っているかのように報じる。CNNの番組につい て初報を打った英紙デイリーミラーでは「謝罪した」ことにフォーカスが置かれ、全世界の報道がそのことでもちきりなのにもかかわらず、だ。

また朝のツイートでも指摘したが、国内で初報を報じたとみられる朝日の記事は、その翻訳の内容からしておかしい。まるで、ブレアの発言の重さを”相殺”するかのような、実に恣意的な訳になっている。これで”両論併記”すれば、総合的には「謝罪しなかった」ことにウェイトがかかる。

なぜ報道価値があるのか


英紙デイリーメールがハイライトした3つのポイントは、ブレアが、①イラク攻撃理由となったインテリジェンス(情報)が誤っていたこと、②IS台頭を招いた (力の空白を生んだ)”第一の要因”であるという指摘に「幾分か事実」(element"s" of truth)があること、③現在のシリアの戦乱に至るまでの状況を生み出した責任があることを、それぞれ大筋で認めたことにある。

たしかにCNNの対談では、ブレアは「サダムを排除したことについては謝罪できかねる」と、結果的にサダムを失脚させたことの功績については頑なに否定しな い。しかし世界の関心事は、「認めなかった」ことよりも、「認めたこと」にある。戦闘終結後長年責任を”一切”認めなかった当事者が戦争の誤りを謝罪した のだから、それこそが伝えるべき価値なのである。

イラク攻撃の支持とイラク自衛隊派遣については、どのような教科書通りの 理屈があるにせよ、当時としては大規模な数万人規模の反対デモが行われたことを記憶している。同時期、お隣の韓国を含めた関係各国では数十万人規模だっ た。そのくらい、「正当性の無い戦争」として世界に見られていた戦争だった。

この”正義なき戦争”を(”正義のある戦争” などもともと存在しないが)、諸手で支持・支援した当時の自公政権、そしてその"後始末"であるイラク復興支援へという名の戦地自衛隊派遣に賛同した人間 は、イラク戦争がもたらした結果を重く受け止め、その道義的責任を負わなければならない。

はからずもこの戦争の最大の当事 者の一翼を担った英国首相は、現在のシリアの混迷した状況を生み出した要因がイラク戦争にあることを大筋で認めた。また単に「一理ある」という月並みな表 現ではなく、「幾分か事実」であることを認めた。つまり幾つかの事実が連なって今の状況を生み出したという認識を示したのである。これは実に重大な発言 だ。

中途半端に行われた政府内検証

では、まず①イラク攻撃を支持し、②その後始末の復興支援のため戦後史上初の戦地派遣というリスクを負ってまで自衛隊派遣を行ったわが国の政府はこのことをどう受け止めているのか。実は2012年12月、安倍政権の発足前、外務省により検証がなされていることは広く知られていない。

ただし、この検証報告には「日本政府が米英等の武力行使を支持したことの是非自体について検証の対象とするものではなく」という但し書きがついている。あく まで「外務省内における検討や意思決定過程」の検証であり、政府全体のものですらない。つまり、安保法制に基づく今後の集団的自衛権の行使に至る判断基準 を検証するものではない。

事実、外務省は「結果的にイラクに大量破壊兵器が発見されなかった現実がある中で,改めてこの期 間の政策決定過程を検証し,もって教訓を学び,今後の政策立案・実施に役立てるとの観点から行ったもの」でしかないことを認めている。もとより検証不足で あることは承知の上での公表なのである。

尚、この政府の検証内容に対し、JVC(日本国際ボランティアセンター)を含む国内の市民社会組織(CSO)6団体は、「検証の内容は不十分」として一蹴し、報告書の全面公開を要求した。だが2015年現在、この要請は受け入れられておらず、また国会内でもこの報告書を検討した事実は確認されていない。

参院での安保法制の審議の渦中、山本太郎議員がイラク戦争の総括を求めた背景には、こうした事実があった。民主党政権下で政治主導の下で行われた「検証」作業は、結局外務省の対応のみを検証するもので、政府全体とくに官邸側の判断を検証するものではなかったからだ。

山本太郎参議の審議で情報提供面で協力したとみられる、フリージャーナリストの志葉玲氏が事務局長を務める「イラク戦争の検証を求めるネットワーク」 がいまも活発に活動している背景には、政府による検証努力が不十分であり、かつ、その中で安保法制により、「次の戦争」に加担する体制が作られようとしていることがある。

先 日10月25日放送の『NHKスペシャル「新・映像の世紀」』の内容は、百年前の1918年に終結した第一次大戦の結果が、いかにして現代まで連綿と続く紛 争の要因となっているかを紐解いた。ではほんの十数年前の戦争は、現代の何の状況に影響しているのか。政府の一部の政策検証等で足りる問題ではない。

英国のブレア元首相は、イラク攻撃が、結果として「サダム失脚」の功績を生んだことを否定しないまでも、現在のIS台頭を招いた要因となったことを認めた。戦争には因果があり、それは次なる戦争の呼び水となる。この真理を認めたも同然なのである。

将来に大いなる禍根を残す安保法制の成立

わ が国の政府は国民の多くの反対を押し切り、国会規則すら満足に守らず、数の暴力によるゴリ押しで、同盟国米豪との共同軍事作戦を可能にする安保法制を成立 させた。満足な歯止めもなく、時の政権の政治的判断により、イラク戦争のように米国の戦争に賛同・支持し、又は参加する蓋然性が高まったのである。

イ ラク戦争時の政府全体、とりわけ首相官邸での意思決定・政策立案・検討・指図内容、責任の所在などの検証は、本来、安保法制を検討する時に、重大課題事項 として国会全体で検証されるべきことだった。また報道も、この必要性を強く主張し、現在に至る疑義のある政治判断として世論喚起を行うべきだった。

こうした総合的な検証と、これに対するメディアの批評による国民全体での検証なしに、私たち日本国民は安保法制という次なる戦争への安易な加担を可能にする法制を成立させてしまった。



イ ラク戦争がIS台頭と多くの難民を生み出す大きな要因となったように、これから日本が加担する将来の戦争も何らかの負の結果を生み、その【直接的責任】を 私たちや次の世代は負うことになる。集団的自衛権の行使容認により「戦争できる国」になるとは、そういうことなのである。


このことが意味する重大さの自覚なしに安保法制を支持し賛同した人間の発想は、安易で、短絡的で、かつ、利己的であると言わざるを得ないだろう。自らの思想信条を優先したがゆえに、将来に渡って、国全体に大きな業を背負わせることになるのだから。

転載:ミドルズ時代『別冊宝島』の緊急出版本『集団的自衛権が発動される時』に掲載された記事

『戦争法案に反対するミドルズ』(MIDDLEs)のスタッフだった頃、立ち上げて1か月ほど経った時に突然、『別冊宝島』のライターから取材の申し込みがあった。ムック本が緊急出版されるという話で、そのためにSEALDsと一緒にMIDDLEsも扱いたいのだという。ところが、書籍の主旨を聞いて驚く。なんと保守・リベラル、賛成派・反対派の論客を集めて「集団的自衛権」について論じる内容だという。それなら私も論客の一人に加えてほしかったが(笑)、残念ながらSEALDsに続いて活動を始めたMIDDLEsとしての取材だというので、快く応じた。1か月後、こんな立派な本↓ができあがっていた。
























しかも目次を見てさらにたまげた。そうそうたる論客(青山繁晴を除いて)で、安保法制の2法案全文も巻末付録として記載されている。資料としても一級の出来。ご覧の通りの重厚な内容だ。↓

そんな内容の中に、SEALDsの運動を扱った全体6ページのセクションがある。ひじょうに読み応えがあるので、SEALDsに関心のある方には是非読んでもらいたい。


以下、上記のハイライト部分を含めた全体の一部を、著者の許可をいただいて全文転記する。私にとっては、MIDDLEsの一員として突っ走った約2か月の一つの痕跡として残った。以下、青文字部分が私の発言と取材部分。それにしても、きれいな言葉にまとめてくれるものである。流石はプロ。

学生たちの生の声が一般の人たちの心を動かした

 SEALDsとはStudents Emergency Action for Liberal Democracy-sの略で、「自由と民主主義のための学生緊急行動」である。彼らのいちばん大きな特徴は、代表者がいないことであろう。SEALDsの顔として明治学院大学の奥田愛基さんが知られるが、彼は代表者ではないのである。
 FacebookTwitterなどのSNSを通して、自らの考え方を発信し、共感する人たちがフォローしたり、DMを送ったりすることで繋がっていった。情報共有はグループLINE。200人前後がいまSEALDsとして活動しているというが、メンバーの名簿などは存在しない。
 そんな彼らのデモでは、「守る」という言葉が多く語られている。冒頭のコールの他にも、“子どもを守れ”“未来を守れ”というのものもあるのだ。
 デモは破壊活動、というのがある種のイメージであった。それが、守るために集まり、声を上げている。15年安保闘争を主導する学生たちは、いまの平和を守りたい、という思いが強いのであろう。

以前の安保闘争では主語は「我々」だったが
現在は「私」となり、個人の意志を主張

 そして彼らの大きな特徴は、名前と所属大学、年齢を明らかにして、一人称で語ることでもある。以前の安保闘争では「我々」だった主語は、「私」となり、個人の意志を表明するのである。そして、スピーチの最後には「私はこの戦争法案に反対します」と、再度個人として語るのだ。

「個人情報を自ら明らかにすることは、現代社会では大きなリスクです。実際に、彼らの情報はネットを探れば驚くほど集められる。中には心ないものも多い」
 と言うのは、SEALDsに触発されることで生まれた、ミドルズの勝見貴弘(42歳)氏である。ミドルズとは、ミドル世代のことで、学生よりも社会経験があり、でも、社会的立場があって表立って行動するのが難しい世代の集まり、である。
「学生はまさに私たちの子どもの世代。彼らが立ち上がらなければならなかったのは、私たちがそんな社会を作ってしてまったからです」
 ミドルズもSNSを使って人を集めている。もちろん、名簿もない。
「子どもにたちに子どもを守れと先に言わせてしまった。未来を守れとも言わせてしまった。安保が必要かどうか、それよりも、まず明らかな憲法違反の法律を通すわけにはいかない。手続き論ですが、憲法を守れ、そこからはじめていきたい」
 一歩先んじてママの会も発足し、SEALDs自体も全国に拡大。高校生の団体も加わった。大きなムーブメントになりはじめているのは事実であろう。その証拠に、8月23日、SEALDsが中心になって呼びかけた、『戦争法案に反対する全国若者一斉行動』は、なんと全国で64か所で行われた。各地で学者や法曹関係者、政治家、そして若者たちがスピーチを行い、街をデモ行進したのである。会場のひとつ表参道では、6500人が集まったのだ。

コラム:そろそろ「国民の安全保証」の話をしよう Time to discuss 'national security'

Introduction

はじめに


今日の日本国民は、国の内と外からの二重の脅威に晒されている。国の内側には大多数の国民が反対する法制を推し進める政府があり、民主主義社会への脅威となっている。国の外側では、私たち日本人にとって決して誇れないい負の遺産を盾に、国内の政治的不満の解消のために反日を利用する”非友好的”な隣国や、非軍事的な活動を装った軍事戦略を展開する国があり、国家安全保障上の脅威となっている。これらの脅威は合わせて、日本国民に対する純然たる脅威を形成している。

そろそろ、私たち国民にとっての安全に対する脅威(threat to national security)とは何か、そして国民の安全保証(national security)とは何かを、あらためて定義する必要があるのではないだろうか。

政府がこれを語る時、彼らは私たち国民の安全保証よりも、国家の安全保障(state security)の文脈で語る。政府にとっては、安全保障(security)とは、領海・領空の確保や防護であり、経済的・地理的意味合いを含む。国民の安全や福祉(safety and welfare)よりも、領土保全(territorial integrity)が、まず念頭にある。



Safety vs. Security

「安全保証」と「安全保障」


政府の第一義的な役割は、国民と生命の財産を守ること。これは既定の事実である。しかし現在の日本では、国民が「安全」(safe)と感じることと、政府が「安全」(secure)と感じることの間で、大きな溝が広がっている。しかも、日本語ではあくまでいずれも同じ文脈で、でも異なる意味で、「安全」と表現される。

現在の政府にとっての「安全」とは、情報の流れを統制し、自らが定義する「反社会的な活動」から公共秩序を守り、ヒト・モノ・アイディア、そして思想信条までを統制することを意味する。彼らにとって「安全保障」とは、国境の管理であり、領土保全が為されることを意味する。

政府にとって「安全」とは「統制」(control)なのである。

私たち国民にとって「安全」とは、食糧について安全と感じること、権利を自由に行使できること、不平・不満を自由に述べられることを意味する。国民にとって「安全」とは、十分な情報を検討した上で選択する自由(informed choice)が保証されること、自分や自分の家族の健康に影響するような事態から自主的に避難する自由(freedom of movement)が保証されること、テレビやインターネット、教育などによりプロパガンダ的な有害な情報を注入されない自由(freedom of information)が保証されることを意味する。

私たち国民にとって、「安全」とは「自由」。恐怖や欠乏からの自由(Freedom from fear or want)なのである。

つまり、「安全が確保された社会」(secure society)を作りたい政府の思惑と、「安心・安全な社会」(safe society)を求める国民の気持ちは、その起点からして真っ向から衝突している。「統制」(control)は「自由」(freedom)は全く噛み合わない。むしろ双極にある。国民の求めること(需要)と、政府が提供できること(供給)は、全く一致していないのである。政府が私たちに与えようとしていることは、私たち国民にとっては二の次、三の次なのある。
では、どのようにしてこのギャップを埋めるのか。

Learning the Facts

事実を知ることから始める


まず私たち自身で、「国民の安全保証」('national security')とは何かをあらためて定義する必要がある。そのためには、「国家の安全保障」(state security)の観点からも、何が必要で、何が必要でないかを判断できる必要がある。

政府の側では、何が国民の利益かという観点から、国民にとって何が必要で、何が必要でないかという判断を理解し、受け入れ、これに基づいて行動する必要がある。つまり、政府の側にも「宿題」があるように、国民の側でも「宿題」をこなしておく必要がある。

国民はせめて、国家の安全保障を維持するの必要な最低限の国防態勢(defense posture)とはどのようなものかを理解する必要がある。

たとえば、日本には”軍隊”は必要なのか。より正しい言葉と実際の日本固有の運用でいえば、”自衛隊”は必要なのか?在日米軍とともに、私たち国民を守り、脅威を抑止し、領土を保全する自衛隊は必要なのか?ここで、自衛隊が合憲か否か、或いは日米同盟(日米安保)が合憲か否かの原則論に埋没すべきなのだろうか?

それとも、少し議論を前進させて、現在の日米安保の枠組みの中での自衛隊の国防態勢は適切かどうかを議論すべきだろうか?現在の枠組みでは、日本は国防の第一義的な責任を負うが、在日米軍に日本を守る義務がある一方で、日本には米軍を守る義務がない。米軍は独自に戦う必要がある。米軍が攻撃されても、日本は米軍を守れない。これは適切なのかどうかを議論すべきだろうか?

私たち国民が許容できる「国防」(national defense)の境界はどこまでなんだろうか?私たちにとって一般的に、平均的に、受け入れることのできる「国家安全保障」(state security)ってどの程度のものなのだろうか?

私たちは果たして、こういう事柄について本質的な国民的議論を行ったことがあるのだろうか?

以下は、私たちを取り巻く一連の安全保障上の事実の数々である。

【事実】


  • 1945年10月 国連憲章が発効。第51条に個別的自衛と集団的自衛の権利が主権国家の自然権として記載される。
  • 1950年08月 警察予備隊が組織される。
  • 1951年09月 旧日米安保条約が締結される。
  • 1952年10月 警察予備隊が保安隊に改組される。
  • 1954年07月 保安隊が改組されて自衛隊が創設される。
  • 1957年12月 砂川判決の補足意見として、最高裁が我が国の自衛権を認める。
  • 1972年10月 国会での政府答弁により集団的自衛権の行使は容認されないことが確認される。
  • 1992年06月 PKO協力法が施行され、自衛隊がPKO三原則に基づき国連の集団安全保障措置に参加できるようになる。
  • 2001年10月 国会でテロ特捜法が成立し、アフガニスタンで展開する「不朽の自由作戦(OEF)」の一環で海上阻止行動(MIO)に参加する他国艦艇に対し、海上自衛隊による補給支援の実施が開始される。
  • 2004年01月 陸上自衛隊が初めて戦地(イラク)に派遣される。
  • 2004年06月 武力事態対処法(有事法制関連7法)が国会で成立し、半島有事や台湾有事に対応する周辺事態対処法制が整備される。
  • 2007年03月 防衛庁が防衛省に格上げされる。
  • 2007年03月 中央即応集団(CRF)が創設される。
  • 2007年07月 政府が国際刑事裁判所(ICC)設立条約(ローマ規程)に加入し、ジェノサイド、戦争犯罪、人道に対する罪について、ICCの管轄権を受託する。
  • 2009年06月 ソマリア沖の海賊に対処するための恒久法として海賊対処法が国会で成立し、多国間協力として海上自衛隊がアデン湾に派遣される。
  • 2014年07月 集団的自衛権の行使を容認し、国連及び国連以外の機関に承認された活動に参加する武力行使権限の拡大を容認する閣議決定が行われる。
  • 2015年07月 国会衆院で与党単独採決により11法からなる安全保障法制案が可決される。←イマココ

覚えておくべきポイント:
  • 自衛隊の合憲性に関する議論は決着していない。
  • しかし現行の法制度では自衛隊は:
    • PKO以外の任務では部隊行動基準(交戦規定)を適用できない。
    • 軍事裁判所を持たない。
    • 他国を攻撃する戦力を保有しない。
    • 同盟国が攻撃されても迎撃できない。
  • そして憲法上、日本は:
    • 戦力を保有できない。
    • 交戦権を認められていない。
    • 国際紛争の解決のために、武力を行使したり、或いは武力による威嚇を行ったりすることができない。
    • 集団的自衛の権利を有してはいるが、行使はできない。
  • 今日に至るまで自衛隊は:
    • 米国主導のOEF-MIOに参加するためインド洋に約9年間海上自衛隊を派遣していた(アフガニスタン)
    • 米国が統治する戦闘地域に1度だけ約3年間派遣された(イラク)
    • 2008年以降、海賊対処のためアデン湾に海上自衛隊を派遣している。
    • ○以下の国で、約15件の国連支援ミッションに参加してきた。

    • 緊急災害救援活動として、以下の国に派遣されてきた。
      • インドネシア (スマトラ津波災害援助/エアーアジア救命捜索)
      • パキスタン (地震災害援助)
      • ハイチ (津波災害援助)
      • フィリピン (台風災害援助)
      • マレーシア (ML370機航空機事故捜索援助)
      • ホンジュラス (ハリケーン災害援助)
      • トルコ (地震災害援助)
      • インド(地震災害援助)
      • イラン (地震災害援助)
      • タイ (地震/津波災害援助)
      • ロシア (潜水艇事故援助)
      • ニュージーランド(地震災害援助)
      • ガーナ(エボラ出血熱輸送援助)

これが、「自衛隊」という、我が国固有の防衛力を持つ実力組織がどのように実際に運用されてきたかの軌跡だ。更に、国内でも、阪神淡路大震災や、東日本大震災で災害救援活動を行ってきたことも忘れてはならないだろう。

「自衛隊」が合憲か違憲かにかかわらず、我が国が、実力のある、効果的で信頼のおける防衛組織を保有することは事実。そして自衛隊が、潜在的な脅威から何度も国土を守り、現在も在日米軍で併せて日本の主権と領土を守り続けているのは事実である。

これらは全て、ただの既定事実である。

Questions that remain unanswered

答えられていない疑問


新安保法制では、この自衛隊の任務、活動範囲、能力、そして米軍との相互運用性を拡大することについて、以下の疑問が投げかけられている。
  • まず必要なのか?絶対に必要なのか?
  • コストやリスクに対するメリットは高いのか?
  • 何が変わり、何が変わらないのか?(参考)
  • 南シナ海や尖閣諸島等の懸念のある地域の現状を変えることにといてどれほど有効なのか?
  • 今の子どもたちが成長した時、将来どのような影響があるのか?徴兵は実施され得るのか?

政府与党は、国会で110時間以上も審議しても、90分間の生番組に出演して、炎を模したアメーバのような物体を駆使したジオラマを使って、これが国際情勢で、安保法制を適用することで火は集団的に消し止められなければならないと、全ての質問に総理自らが答えても、これらすべての疑問に対する明確な回答は未だ得られていない。



政府与党は、野党が国会で違憲性に関する審議に集中し過ぎたため、国民の十分な理解が得られていないと野党の責任にしている。政府からすれば、違憲性の審議は外堀的な価値しかなかった。しかし、違憲性こそは、これだけ物議を醸す重要法案の入り口の議論として不可欠であり、そこでは反論の余地のない政府答弁がなされなければならなかったのに、政府にはそれができなかった。与野党が招致した参考人は全て、安保法制には違憲な部分が幾つもあり、違憲であると判断せざるを得ないとした。

結果的に、審議は野党の同意なく110時間で打ち切られ、与党は委員会で強行採決を行い、本会議で可決した。このプロセスに、野党や国民のコンセンサスは得られていなかった。最新の世論調査では、最低でも全体の六割以上(実際は八割以上という説も)が、法案の審議や説明は不十分で、採決は時期尚早だという声を占めた。その結果として、累計20万人もの人々が国会議事堂や自民党本部前に陣取り、毎週のように抗議を行っている。


この国民の強い不満を和らげるためには、政府は今後56日以内に、少なくとも以下の5つの疑問に応えなければならない。
  1. なぜ必要なのか。
  2. どのようなコストやリスクが伴うのか。
  3. 短期・中期・長期的にどのような影響が想定されるのか。
  4. 現在の紛争の解消にどのようにして役立つのか。
  5. 国民の生活にどのような影響が長期的に想定されるのか。


Time to discuss 'national' security

Introduction


Today, the Japanese people are confronted with a dual threat from within and beyond our borders. Inside, we have a government that opts to enforce laws against the will of the vast majority of the people; a genuine threat to our democracy. Outside, we have 'unfriendly' neighbors who take advantage of our not-so-proud past for internal political gains or proceed to intimidate us and our neighbors with clandestine military operations; a genuine threat to our 'state' security. Together, these two threats represent a threat to the 'national' security of the people of Japan.

We have to re-define, or correctly define what is threat to our 'national' security and what 'national security' is. National security, when spoken by our government representatives, often is more about 'state' security than about the security of the people. It's more about maritime and aerial borders. It's more about economic and geopolitical implications. It's more about territorial integrity of our 'state' than well-being and safety of our 'nation.'

Safety vs. Security


The first role of any government is to protect its people's lives and asset. This is a given. But there is increasingly a growing divide between what people view as "safety" versus what the government view as "security" in Japan, all spoke in the same context but with different meaning, but in the same word; 'anzen'.

The government views security ('anzen') as a need to control the flow of information, or protect social order from being vandalized by anti-social actives defined by themselves. They view security as the need to control the flow of people, goods, ideas, and even thoughts. They view security as the need to control the borders, maintain the territorial integrity of our state.

For the government, It's all about about control.

The people view safety ('anzen') as a need to feel safe about food, about being free from expressing their rights, about being free from expressing dissent. We view safety as being free from making informed choices, moving freely between internal borders to escape from what we deems as threats to our individual and collective health of a family, free from being intoxicated by propaganda information on television, Internet, and from education. We view safety as a collective need to feel secure from all of the above and more.

For us, it's all about freedom. Freedom from fear or want.

So in fact the designs of the government to create a 'secure society' and people's desire to have a 'safe society' is in direct conflict from the onset of its inception. Control does not bode well with the desire for more freedom. In fact it's the exact opposite. So the people's demand, and the government's supply does not match at all. It even clashes. What the government seeks to provide is at best tertiary to what the people needs.

So how can this gap be amended?

We the people need to re-define what 'national security' means. We need to understand and accept from the viewpoint of state security what is essential and what is not. The government needs to understand , accept, and act out from the viewpoint to serve the people's interest  on what is essential and what may be  not. So we have to do our homework on our side. as much as the government needs to on their side as well.

The people needs to understand what is the basic minimum defense posture needed to maintain the 'security of a state.

First of all, do we need armed forces, or in our unique pacifist lingo and legal implementation, the Self-Defense Force capable of defending our territories, us the people, and deter threats together with the presence of the U.S. military in Japan?

Should we delve into the Constitutional question of whether the SDF is legal or not or whether the alliance with the U.S. is legal or not?

Or should w e at least advance our discussion to the next level to determine how appropriate our defense posture is with the current framework of Japan-U.S. alliance where Japan has the obligation to do its utmost to protect the nation when under attack and where the U.S. Forces in Japan has the obligation to protect Japan and if attacked fight on its own?

Where is our acceptable line of a definition for "national defense"? What is our average, acceptable view of how our 'national security' should be maintained? Have we actually discussed the substance of this ever before?

Learning the Facts


Here are some if not all of the facts surrounding our security environment.

Facts:

  • October1945, the UN Charter goes into force and the right to individual and collective self-defense has been guaranteed as inherent right of any nation under Article 51 of the Charter.
  • September 1951, Japan sign the former Japan-U.S. Security Treaty
  • July 1954,  JSDF is established under the secret agreement.
  • December 1957, the right to self-defense was confirmed in the  Supreme Court supplementary opinion.
  • October 1972, the right to exercise the right of collective self-defense was  denied through government interpretation.
  • June 1992, the Peace keeping Operations Law was enacted to allow deployment of JSDF to UN-sanctioned operations under the three principles.
  • October 2001, the National Diet approves the Special Anti-Terror Operations Act which allows the deployment of MSDF to the Indian Ocean to support the allies in Operation Enduring Freedom Afghanistan through refueling missions.
  • January 2004, the GSDF was deployed for the first time to a warzone in Iraq.
  • June 2004, the contingency laws are enacted in anticipation of contingency situation in the Korean Peninsula and Taiwan which included 7 related legislation
  • March 2007, the Defense Agency is promoted to a Ministry of Defense.
  • July 2007, Japan acceded to the Rome Statute for the Establishment of International Court in and accepted ICC's jurisdiction over crimes of genocide, war crimes, and crimes against humanity.
  • June 2009, the National Diet approves a permanent Anti-Piracy Operations Act which allows the deployment of MSDF to the Gulf of Aden for multinational anti-piracy activities.
  • July 2014, the Cabinet Decision to allow re-interpretation of the right to collective self-defense and expanded use of force and increased role in UN and non-UN sanctioned activities was approved.
  • July 2015, a package defense bill of 11 draft legislation were passed in the Lower House of the National Diet by sole vote of the majority coalition.  <-- WE ARE HERE


Key Points to remember:

  • The constitutionality of JSDF has not been determined.
  • Under the current law, JSDF does not:
    • Employ Rules of Engagement unless in PKO
    • Have a military tribunal system
    • Retain war potential to attack other country
    • Have the right to defend our allies even upon attack
  • Under the current constitution, Japan does not:
    • Retain war potential
    • Have right to belligerency
    • Have right to use or threat to use force to resolve international conflicts
    • exercise the right to collective self-defense  though it retains the right to do so
  • Until today, the JSDF has been:
    • Deployed to the Indian Ocean for a refueling mission with OEF-MIO led by the U.S. for 9 years (Afghanistan)

      • Indonesia (Sumatra Tsunami Relief/Air Asia R&R)
      • Pakistan (Earthquake Relief)
      • Haiti (Tsunami Relief)
      • The Philippines (Typhoon Relief)
      • Malaysia (ML370 Search & Rescue)
      • Honduras (Hurricane Relief)
      • Turkey (Earthquake Relief)

This is where we stand today in how we have employed our unique defensive capability, not mentioning the numerous national disaster relief efforts the JSDF has engaged since its establishment including the Great Kobe Earthquake and the Great Tohoku Earthquake.

So regardless of where it stands in the Constitution we have a highly capable, efficient and reliable defense force which we maintain to ensure the 'national security' of this country. It has deterred many attempts by a potentially hostile forces and it continues to protect the sovereignty and territorial integrity of Japan, along with the U.S. Forces in Japan.

This is a given.

Questions that remain unanswered


The questions posed by the new security legislation were to expand the role, scope, the capability, the interoperability with U.S. Forces in Japan and abroad, of the JSDF. These questions remain unanswered:
  •  Do we need to?  Is it absolutely necessary? 
  •  Is it worth the cost and/or risk? 
  •  What will change? What won't change? 
  •  How does it affect the present situation in volatile regions, such as the South China Sea or the Senkaku Islands?
  •  How would it affect our children when they grow up? Will they be drafted?

Unfortunately, the government hasn't been able to provide us with clear answers even after 110 hours-strong deliberation in the Lower House of the National Diet, or direct appearance of the Prime Minister in a special 90-minute TV show to explain and respond to Q&As all by himself using a blob-like figure that supposedly represents a fire to be collectively extinguished for the security of Japan and the rest of the world by applying the new legislation.



The government blames the opposition parties for focusing too much of its questions on the constitutionality and legality of the legislation which they deem periphery to what the legislation actually stands for. However, legality is the entry point of any legislation as controversial and significant as this and a clear, uncontested answer should have been provided. But the government could not. All three constitutional experts handed down the judgment that the legislation is flawed with violations to the Constitution.

As a result the debate was forcefully cut short and without consent from the opposition the ruling coalition steamrollered the bills and placed on the plenary vote. The bills passed, with no consensus from the opposition or from the public. Most recent polls show  that more than 60 percent of the public still believe that the bill hasn't been explained in full to qualify to be put to a vote. As a result, more than 100,000 people gathered in front of the National Diet and LDP Headquarters to protest against the steamrollering on a weekly basis.

In order to appease this strong public resentment, the government needs to be able to answer at least the following five questions in the next 57 days:

  1. WHY is it necessary?
  2. WHAT would be the cost/risk of its implementation?
  3. WHAT would be the estimated immediate/mid-term/long-term effect be like?
  4. HOW does it help to resolve current disputes?
  5. HOW would it affect the general household in the long-run?

Conclusion


Without being able to supply even a part of the answers to these fundamental questions, the ruling coalition is doomed to fail. The people wants to feel 'safe' not 'secure'. The government thinks we can be more 'secure' while we don't feel 'safe' at all listening to their reasoning (if there is any).

While the government struggles to find the logical answers, we the people should also delve to deepen our understanding on the actual pros and cons of this legislation. provided that we at leas acquire the basic understanding of where we stand. Then we can finally compare  and evaluate the pros and cons to make an informed decision. And we can all self-educate ourselves so we can be better prepared to scrutinize the often optimistic best-case-scenario answers the government would provide.

When we the people have a good understanding of the actual security situation, understand our 'safety' needs, we can then rightfully and convincingly give the government, a definite NO. Giving an YES is not an option, but we must have a good reason. That would form the basis of our own security legislation that would guarantee not only the security of the state, but the safety of the nation; us.

Collective Defense is a hot topic these days.  Prime Minister Abe is going hot on sending the Japanese military overseas.

昨今、集団的自衛権(安保法案)が話題です。安倍首相は、日本の軍隊(自衛隊)を海外派遣する為に一生懸命頑張っています。

Well, I agree with him on certain points, but other points we should be careful about.

私は一定の点までは彼に同意なのですが、他の点で注意すべきことがあります。

In my opinion, the best thing Japan could get out of this would be combat experience.  There is nothing better than combat experience in teaching a military how to fight a war.

私の意見としては、この集団的自衛権の行使容認で日本が得られる一番の国益は戦場経験です。戦争での戦い方を覚えるのに、戦場経験ほどベストな方法はありません。

No matter how much you train in peace time, things are different in wartime.  There are some voices, I have read this in the English language newspaper, The Japan Times, that Japanese cannot be good soldiers.

平時にいくら一生懸命訓練しても、戦時はやはり違います。The Japan Timesなどの英字新聞によると、「日本の自衛隊はいい兵隊にはらない」という声があるそうです。

They say that other countries military wouldn’t like Japanese troops in the area, because they are amateurs.

「自衛隊は素人だから、他の国の軍隊は日本と同じ領域で活動したくない筈だ」というのです。

This is just masochistic thinking.  Post WWII, America imposed it’s propaganda on Japan that Japan was somehow evil for going to war.

これは、自虐的な考え方です。

大東亜戦争後、アメリカは「日本が悪の国で戦争を始めた」と、自分達のプロパガンダを日本に押し付けました。

Too many Japanese people believe this.  The facts are, America provoked that war with Japan to save China.  They mistakenly thought China would be America’s servant.

こうしたプロパガンダを信じている日本人が多すぎます。事実は、アメリカが日本から中国を救う為に日本を戦争の道に引きずり込んだのです。アメリカは、中国がアメリカに従属すると思い込んでいました。完璧に、アメリカの間違いです。

The facts are, The war in the Pacific was an American mistake.

事実はどうかというと、太平洋戦争はアメリカの過ちだったということです。

In any case, I do not doubt that in the Japanese military, there are people who regard themselves as civil servants, rather than as military personnel.

いずれにせよ、私は日本の軍隊、現在の自衛隊の人びとの中には、自らを軍人よりも公務員であると考えている人が必ず居ると思っています。

In wartime, these people will either change to tough military people, or fail at their jobs, and be put aside.  And yes, their failure at their jobs may cost the lives of other Japanese personnel.

戦時に、彼らは強力な兵隊へと変貌するか、任務に失敗して、使い捨てにされるでしょう。勿論、彼らが失敗するということは、他の日本側の人間の命が失われることを意味します。

But this is the same in any country’s military.  Think of the Dutch military.  They have 47,000 personnel.  But how many of them really seriously think about fighting a war?  If they ever did come into combat, they would suffer.

でもこれは、どこの国の軍隊でも同じことです。オランダの軍隊を例にとってみましょう。

オランダ軍兵士は約47,000人います。しかしそのうち何人が真剣に、戦争で戦うことを考えているか。戦場では、苦しむことでしょう。

In WWII, America had the same problem.  The pre war military was very small, too many new American troops thought like civilians.  This was the reason for Allied landings in North Africa in WWII, to new American soldiers experience.  And yes, mistakes were made, but people learn from mistakes.

第二次世界大戦で、アメリカも同じ問題に直面しました。戦前の軍隊はとても規模が小さく、兵士の数は少なく、新兵の多くが普通の市民のように振る舞いました。そのため、北アフリカの上陸作戦では、これら新兵が投入されたのです。学習の為だったのです。そして過ちが起きました。が、しかし、人間は過ちから学習します。

So I do think that the Japanese armed forces would be able to handle themselves in a Combat Situation.

だから、私は日本の自衛隊は戦場においても十分対応できると思っています。

But the thing we must be careful about is geography.  We should not let America send large contingents of Japanese troops to say, Iraq.  Why?  Well, for one reason, the Iraq war is hopeless, Japanese troops cannot make a difference.

しかし、世界のどこに自衛隊を展開するかについては注意が必要です。アメリカの要望で、たとえばイラクに自衛隊を展開することは避けましょう。なぜか?それは、イラク戦争には望みがないからです。自衛隊が行っても、何も戦況を変えることはできません。

And it is too far from Japan.  I think we should not send troops west of the Malacca straits.

それに、日本から遠すぎるのです。マラッカ海峡より西へは派遣しないことが賢明です。

I can see Japanese military help for Vietnam or the Philippines in the South China sea.  However we should be careful not to try to retake islands in the South China sea.  But occupying certain areas not yet taken by China could send a message.

日本の自衛隊が南シナ海で、ベトナムやフィリピンを軍事的に支援することは想像の範疇にあります。しかし、南シナ海で中国から領土を奪うことは避けたほうがよいでしょう。その他の、まだ中国が上陸してない島を占拠すれば、中国側への有効なメッセージになるかもしれませんが。

Japan has successfully defended the Senkaku islands from Chinese provocations without American help.  America refused to commit itself on whether the islands were Japanese territory until China had given up.

日本は、まったくアメリカの手を借りずに、尖閣諸島を守り抜きました。中国が尖閣を諦めるまで、アメリカは尖閣諸島を守ろうとしませんでした。

But the straits of Hormuz are too far.  And Iran is not Japan’s enemy.

でも、ホルムズ海峡は遠すぎます。それに、イランは日本の敵国ではありません。

America is making a serious mistake by continuing to treat Iran as an enemy.

アメリカがイランを敵扱いにしていることが、大きな誤りなのです。

Japan cannot support an expeditionary force at such a great distance by our resources alone.  We must depend upon America, and America is no longer a reliable country.

日本の現有能力では、遠征部隊を派遣することはできません。そのためには、アメリカを頼る必要があります。しかし、アメリカはもはや頼れる国ではないのです。

This is what I mean:  America is facing three great disasters.  An unprecedented ecological disaster as the United States west of the Mississippi river turns to deep desert.  Most of the people who live there now will have to evacuate or they will die in place.

私が言いたいのは、こういうことです。

アメリカはこれから三つの大災害に見舞われます。大規模自然災害です。

まず、ミシシッピーより西が深い砂漠になり果てます。周辺の住民は避難するか、その場で朽ち果てるかの選択肢しかありません。

The end of shale oil, and the end of the US transport system.  93% of the US transport system depends on oil.  Shall oil was a fantasy from the beginning.

シェールオイルの宴が終焉を迎えます。それはアメリカの交通網の死を意味します。アメリカの交通システムはその93%がオイルに依存しています。しかし、シェールオイルははじめから、幻想でしかなかった。アメリカの交通システムはこれから、完全に崩壊します。 

The present economic crisis in Greece is a bad sign.  But such an event was only a matter of time.  I think that more and more countries will now default, and the world wide economic system collapse.

現在のギリシャの経済危機は悪い兆しを示しています。しかし、こうした危機が起きるのは時間の問題でした。徐々に他の国もデフォルトに陥って、世界経済が崩壊します。

And this includes the US economy, they never repaired the damage done by the Lehman shock.

これには勿論、アメリカ経済も含まれます。
リーマンショクからもまだ立ち直っていないのに。

And what of Japanese military personnel who die in overseas conflicts?  Believe me, it will happen.  Will they be enshrined in Yasukuni?  Can they government guarantee that they will resist American pressure on this issue?

すると、海外で死亡する自衛隊員はどうなるでしょう?死者は確実に出ますよ。彼らの御霊も靖国神社に合祀されるのでしょうか。日本政府はこのことで、アメリカに抵抗すると保証できるのでしょうか?

The law for collective defense with America has not yet passed.  Yet I saw this article in the American military newspaper Stars & Stripes.

集団的自衛権の行使を可能にする法律(安保法案)はまだ成立していません。でも、アメリカの軍事新聞である『星条旗新聞』(Stars & Stripes)にはこんな記事が掲載されていました。

The fact that America has already budgeted Japan’s role means that America is thinking Japan will play a major role in the future.

アメリカが日本の将来の軍事的役割をすでに予算に組み込んでいるということは、日本がこれからアメリカの戦争で大きな役割を担うと、アメリカが睨んでいることを意味します。

This would be a combat role, and at a guess, would involve more than 10,000 ground troops, and Naval and Air units.

それは、前線で戦うということ。推測ですが、陸上部隊1万人以上、さらに海上・航空部隊も含まれるでしょう。

Certainly, America is not thinking that Japan will be a minor actor in a behind the lines role.

当然ながらアメリカは、日本が後方支援の役割を演じることを想定していません。

Japan will need a draft to maintain such a force in the Middle East.

Concerning Japanese military participation in American wars, Americans use these phrases, “Japan gets a Free ride”, this means America protects Japan, but Japan does nothing in return.

アメリカの戦争における日本の軍事的貢献を、アメリカ人はよくこのようなフレーズで表現します。

“Japan gets a Free ride”
「日本はいつもただ乗りしている」と。

つまり、アメリカは日本を守るのに、日本はそのお返しに何もしないと。

Americans do not know that Japan pays much for the upkeep of US bases in Japan.  And they will not care.  They will look on this as weakness.  They call this “Checkbook Diplomacy”  which means that Japan pays money instead of fighting.

日本が在日米軍基地の維持管理の為(思いやり予算)に、どれだけの金を払っているか、アメリカ人は知りません。気にもしていません。アメリカ人はこれを日本の弱みだと捉えます。金を払うしか能がないと。これを、“Checkbook Diplomacy”(小切手外交)  といいます。つまり、日本は自らは戦わずに、金を出すだけということです。

To Americans, this is bad, it means Japan is not a trustworthy ally.  What they want to see is “Boots on the ground”.  This means Japanese combat troops fighting in the same battles as Americans, and dying like Americans.

アメリカ人にとって、これは悪い意味しか持ちません。同盟国として信頼出来ないということだからです。

アメリカ人が見たいのは、“Boots on the ground” (ブーツ・オン・ザ・グラウンド) 。つまり、自衛隊員がアメリカ兵と同じ戦場で共に戦い、アメリカ兵と共に死ぬ事です。

In a previous blog post, I said it is not in Japan’s interest to send troops to fight west of the straits of Malacca.

以前のブログ記事で、私は、「マラッカ海峡より西に自衛隊を送ることは日本の国益にはならない」と書きました。

America’s entire Middle Eastern policy, and most American wars, are mistakes.  Failures.  Japan will be pulled into these mistakes.  Terrorism inside Japan will become a definite possibility.  Japan will become a country hated around the world, just like America is now.

アメリカの中東政策のすべて、そしてほとんどのアメリカの戦争は過ちでした。失策です。日本はこれから、その過ちに引きずり込まれるのです。

日本国内でテロが起きる確率は確実に高まるでしょう。そして将来は、アメリカのように世界中で嫌われる国になるでしょう。

And in Japan we will have to learn a new English phrase.  This is “bodybag”.  It is what Americans use to ship the bodies of dead troops home.

そして日本人は、新しい英語の言葉を覚えることになるでしょう。

“bodybag” (ボディ・バッグ) です。
米軍でこのようにして、兵士の遺体を詰めて本国に還す時に使う袋のことです。




We can expect a flood of such bags in the future.
将来、この袋が日本に溢れかえることになるでしょう。
